Privacy Statement
Ya Yin Music Company Rental Policy Rev. June 2010 Please take the time to review our rental policy. Note that accepting possession of a rental instrument indicates your agreement to these terms. Rental Outfit. In exchange for your rental and $45 deposit fee (to be refunded upon instrument return), we will provide a quality outfit including: instrument, bow, case, rosin, and a complimentary cleaning cloth. Rental Period Structure. There is an initial rental period of three months. For shipping customers, the initial rental period will be four months, with the fourth month being free. After the initial rental period, your contract as well as credit card charge will renew automatically each month. By "month", we mean the same day of each succeeding month. For example, if you start renting on January 1, your initial three month term would end on March 30. On April 1 your monthly billing cycles would begin - your credit card would be charged April 1, May 1, June 1, etc. for your rental. Contract Termination. You may cancel this agreement with no further obligation at any time by returning your instrument to us. Leaving the instrument with a teacher or school will not constitute being returned. It is the customer's responsibility to ensure instruments are in our possession before the monthly billing dates to avoid being charged another month. Please note that using the instrument for even a fraction of a month will be considered as a full month of rental. We do not give prorated refunds for instruments returned before the monthly due date. Strings. If a string breaks during the first three months, please contact us and we will send single string replacements at no charge. After the first three months, we will deduct the string cost from your deposit upon the return of your instrument. For string pricing, please see our online store. Residue. We kindly request you return your instrument to us in the same condition as you found it. Please do not leave tapes, stickers, or other items on the instrument unless we have a prearranged agreement. Otherwise, we will deduct $5 from your deposit. We reserve the right to be the sole judge in these cases. Insurance. Your rental fee includes a $5 insurance charge for the instrument. This covers: maintenance and repair for normal wear and tear of the instrument, broken strings during the initial three month rental period, accidental damage, theft from a secure environment, and fire. Theft and fire cases must be submitted with a police or fire report filed within 24 hours of the occurrence. We do not cover: the accidental loss of an instrument, theft from a vehicle, heat damage to the varnish, intentional or malicious damage such as scratching, damages due to an unauthorized repair attempt, or reimbursement for shipping costs. We also do not cover loss due to flood, earthquake, or other natural disasters. Please note this insurance will not be in effect during air or overseas travel. Also, if the instrument is lost to theft or fire all credit equity accrued will be lost. Rental Credit. You may apply up to one year of rental credit towards the purchase select full sized instruments. Please note that the rental insurance charge is not counted toward your credit. This offer remains valid as long as your rental contract is intact. Credit may only be applied to the same kind (violin, viola, etc) of instrument currently being rented. Renter Responsibility. It is your responsibility to make sure your credit card is renewed and that your contact information is updated and correct. If we are unable to process your credit card, we will contact you by the email and phone you have provided. The grace period during which you may provide a valid credit card number or an alternative form of payment is 14 days after the rental due date. If you have failed to contact us to make alternative payment arrangements, or if no check or other payment has been received after 14 days, there will be a $25 fee. There will also be a $25 fee for all returned checks. All accounts that are over 90 days past due may be turned to a collection agency. Accounts turned over to a collection agency will be liable for both the retail value of the instrument and the past due rent. In the event of legal action or use of a collection agency, any associated fees will become the responsibility of the renter. We reserve the right to use all reasonable actions necessary to take possession of unreturned rental instruments and to collect all past due rental fees, late fees, legal fees, and collection costs. If legal action is necessary, exclusive venue shall lie with the court of competent jurisdiction in Dupage County, Illinois. Terms. We reserve the right to make reasonable changes to the terms of this contract without advance notice to the renter. Money Back Guarantee. If for some reason you are not happy with the instrument, return it to us within the first 14 days of your initial rental period for a full refund.
